References to “Nova Vacation LLC,” “we,” or “us” are meant to include Nova Vacation LLC, its subsidiaries, and its affiliates.
These Terms and Conditions (“Agreement”), along with our Privacy Policy (as it applies to users outside the UK and EU), govern your use of our Service and the properties we offer (“Properties,” further defined below). By accessing or using our Service or Properties, you agree to be bound by this Agreement, which forms a legally enforceable contract. Your failure to comply may result in civil or criminal liability.
ARBITRATION NOTICE FOR NON-UK AND NON-EU USERS
Except in specific circumstances detailed in Section 17, all disputes arising under this Agreement will be resolved through binding, individual arbitration. BY AGREEING TO THESE TERMS, YOU AND NOVA VACATION LLC EACH WAIVE THE RIGHT TO A JURY TRIAL and the right to engage in any class action or representative lawsuit. You acknowledge you give up the right to go to court (except for small claims matters), and your case will be decided by an arbitrator, not a judge or jury. Further details are in Section 17.
1. OVERVIEW OF OUR SERVICE
Nova Vacation LLC acquires and manages accommodations in various locations, including within the United States (but excluding Mexico). We showcase physical properties owned, managed, leased, licensed, or rented by us or our affiliates (each a “Property,” and collectively “Properties”). Via our Service, you may:
Make short-term rental reservations (“STA/Hotel Reservations”)
Reserve longer-term accommodations (“Extended Stay Reservations”)
In each case, reservations include our express, written permission for temporary non-commercial occupancy, contingent on your adherence to these Terms. Please note that while the Properties themselves do not form part of the “Service,” any ancillary or on-site services we or our third-party providers may offer to guests (collectively, “On-Site Services”) are included in the Service.
2. SUPPLIER OF RECORD AND AFFILIATES

We reserve the right to change the Supplier of Record at any time without prior notice. Other affiliated entities of Nova Vacation LLC (“Nova Vacation LLC Support Entities”) may assist in delivering certain services, such as concierge, housekeeping, or other property-related support. These support entities do not form a direct contractual relationship with you unless otherwise specified.
3. ELIGIBILITY
You must be at least 18 years of age to use our Service. By entering into this Agreement, you certify and warrant:
You are legally an adult (or have obtained necessary parental or guardian consent) and can competently enter into contracts.
You have not previously been suspended or removed from our Service or any Property owned or managed by us.
All information you provide to us is accurate, and your use of our Service and Properties complies with all applicable laws, regulations, and rules.
If you act on behalf of a corporate entity or organization, you confirm you have the authority to bind that organization to these Terms.
4. REGISTRATION AND ACCOUNT MANAGEMENT
To enjoy certain features of our Service, you may need to create an account (“Registration”). In doing so, you might provide personal details like your name, email address, physical address, date of birth, and more. You are responsible for:

Keeping your login credentials secure.

5. BACKGROUND CHECKS
Where permitted by law, Nova Vacation LLC reserves the right—but not the obligation—to conduct background checks on individuals reserving or occupying a Property. These checks may involve:
Verifying your identity (through an official ID or other data).
Checking databases or credit references.
Accessing public records of any relevant criminal convictions or sex-offender registrations for users outside the UK and EU.
By proceeding with a reservation, you consent to these checks and the potential sharing of results with landlords or property managers for legitimate safety and fraud-prevention reasons.
6. FEES, PAYMENT, AND PRICING
6.1 Applicable Charges
Certain portions of the Service require payment of fees (e.g., reservation costs, security deposits, or On-Site Services). You’ll have an opportunity to review and accept any applicable fees before finalizing payment. All fees are non-refundable unless otherwise stated in writing by us.
6.2 Price Adjustments & Currency
Prices may change at any time, and we strive to keep online pricing updated. Final charges will be presented before you confirm your booking. The currency used for billing will depend on your payment method and the location of the reserved Property. For your convenience, we may display approximate conversions, but actual exchange rates can differ and may include additional margins.
6.3 Authorization and Payment Methods
By submitting a reservation, you permit us to charge the designated payment method (“Applicable Payment Method”) for all sums owed, including deposits, taxes (e.g., sales tax, occupancy tax), and any fees for On-Site Services. We may place a hold on your credit card to cover potential damages or unpaid fees. Should your credit card provider charge any service fees in connection with the use of the Applicable Payment Method, you are responsible for those fees.
7. CANCELLATIONS AND MODIFICATIONS
7.1 Short-Term Rentals (STA/Hotel Reservations)
We will bill you at the time you request a STA/Hotel Reservation. Cancellation rights and refund eligibility depend on the cancellation policy current at the time of your booking. Please check https://www.novavacation.com/cancellation-policy for the details. If you book through a third-party site, stricter terms may apply.
7.2 Extended Stays
When booking Extended Stay Reservations, payment is due once the reservation is officially accepted and an Extended Stay Agreement is fully executed. Cancellations after the Agreement is signed are not allowed, except where the Extended Stay Agreement or law explicitly permits.
7.3 Alternative Property Assignments
In rare cases where a Property becomes unavailable during your reserved dates, Nova Vacation LLC will attempt to find and offer suitable alternatives. If we cannot arrange this, we may cancel your reservation and refund any prepaid fees. If the offered alternative is refused, you may also cancel and receive a refund; no additional liability or compensation is owed to you.
7.4 Reservation Modifications
You may adjust your reservation’s date or features, subject to potential price changes and availability. If you choose to extend your stay, the rates in effect at the time of modification (which may differ from your original rate) will be applied.
7.5 Repeated or Abusive Cancellations
Excessive cancellations may lead us to temporarily or permanently revoke your access to our Service.
7.6 Delinquencies
If any amount remains unpaid on your account, we reserve the right to suspend or terminate your use of the Service or the Properties. Additional charges, such as collection costs, may apply.
7.7 Taxes
We may collect and remit taxes, such as sales and occupancy taxes, depending on local requirements. Actual tax amounts will be based on prevailing rates applicable during your stay.
7.8 Disputes on Credit Card Charges
If you believe the booked Property is not as advertised, you must contact us in writing within 24 hours of check-in or discovering the issue. Supporting evidence (e.g., photos, videos) may be requested. We cannot offer any remedy if you raise such concerns after you have completed your stay.
8. RIGHTS AND RESPONSIBILITIES FOR PROPERTY USE
8.1 Limited License to Access the Service
While complying with this Agreement, you have a personal, non-exclusive, and revocable license to install and use our mobile applications (if available) and access our Service. If you are an organization booking Properties for employees or students, ensure each individual consents to these Terms and that you have a separate agreement with us allowing limited non-personal usage.
8.2 Short-Term Occupancy Rights
For valid STA/Hotel Reservations, you gain a short-term, exclusive right to occupy a specifically reserved unit for a defined duration (“Period of Occupancy”). This right ends once the reservation expires, and there is no ongoing entitlement to extend or renew. Any operational or maintenance concerns should be communicated directly to us at support@novavacation.com.
8.3 Extended Stays
For Extended Stay Reservations, you must sign an Extended Stay Agreement. No occupancy rights exist until the Agreement is fully executed. Details such as the exact unit and length of stay will be in that Agreement or a subsequent Confirmation. Again, direct any issues to us, not the landlord or third-party staff.
8.4 Property Entry by Nova Vacation LLC
To the extent allowed by law, we may enter the Property during your stay for reasons like:
Emergency or urgent repairs.
Addressing maintenance or safety concerns.
Investigating suspected illegal or damaging activity.
Exhibiting the Property to prospective renters or buyers.
Ensuring compliance with house rules.
In each case, we will follow any legal requirements concerning notice and consent.
8.5 Feedback and Suggestions
Any suggestions or feedback you offer regarding our Service or Properties (collectively, “Feedback”) grant us a perpetual, unrestricted right to use such ideas or improvements without obligation to compensate you.
9. YOUR OBLIGATIONS AND RESTRICTIONS
9.1 Compliance with Laws
Your use of our Service and Properties must at all times align with applicable local, state, national, and international laws. We do not discriminate, and we comply with all fair housing regulations.
9.2 Amenities and On-Site Services
Some Properties offer amenities (e.g., pools, gyms, parking) for communal use. There is no guaranteed availability, and usage is strictly at your and your guests’ own risk. We may also provide optional On-Site Services—such as cleaning or babysitting—where available and at an additional fee. By using these amenities or services, you acknowledge you are doing so voluntarily and release Nova Vacation LLC from any liability associated with accidents or injuries to the fullest extent permitted by law.
9.3 Maintenance and Cleanliness
You must keep the interiors of the Property clean, orderly, and free of pests. Promptly report any mechanical or maintenance issues to support@novavacation.com.
9.4 Prohibited Conduct
You agree not to:
Use the Property for illegal activities or unauthorized commercial operations.
Impersonate anyone else or falsify personal details.
Reproduce, modify, or distribute Service content without our written permission.
Introduce dangerous items, weapons, or hazardous substances into the Property.
Tamper with any safety or security features (e.g., smoke detectors).
Commit harassment or create disturbances affecting neighbors or other occupants.
Violate any additional terms or policies we disclose to you from time to time.
9.5 Safety Measures
Many Properties include features like smoke detectors and fire alarms, which must remain functional. You must not deactivate them, and you must report any malfunction or battery issue right away.
9.6 Damages and Personal Property
You are accountable for any damage caused by you or your guests (including pets) to the Property. If we reasonably believe such damage or theft has occurred, we will notify you, and if you do not respond within two business days, we may charge your payment method the full cost of repairs, replacements, or lost income (“Damaged Property Fee”). We are not responsible for your personal items left behind or damaged; any belongings left after check-out may be discarded, and you bear any costs incurred.
10. INTELLECTUAL PROPERTY AND THIRD-PARTY LINKS
The Service, including its underlying technology, design, and materials, belongs to Nova Vacation LLC and/or its licensors. You have no right to use these elements beyond what is expressly permitted. We may incorporate links or integrations with third-party websites or services; we do not control those entities and are not responsible for their terms or privacy practices.
11. USER-GENERATED CONTENT
Our Service may allow you and others to post comments, reviews, or other user-submitted material (“User Content”). While you retain rights to that material, by uploading or sending it, you grant us a worldwide, non-exclusive, and transferrable license to use, reproduce, distribute, adapt, and display it. We may remove or edit User Content we deem objectionable.
11.1 Reviews and Ratings
You and others may post reviews and star ratings after a stay. Such content is solely the author’s opinion and not necessarily ours. We do not guarantee its accuracy and may remove any postings that violate this Agreement or applicable law.
12. COPYRIGHT INFRINGEMENT (DMCA)
We comply with U.S. Digital Millennium Copyright Act (DMCA) regulations. If you believe copyrighted material is posted on our Service without authorization, please send a notice to:

13. REVISIONS TO THESE TERMS
We may update this Agreement at our discretion. If substantial changes that affect your rights occur, we will notify you and ask you to consent to the new terms. Non-material changes become effective when published. If you disagree with revised terms, you should discontinue using our Service and Properties; continuing to use them signifies your acceptance of the updates.
14. TERM AND TERMINATION
14.1 Effectiveness
For short-term rentals, this Agreement goes into effect once you accept it or otherwise begin using our Service for STA/Hotel Reservations and continues until terminated as described below.
For extended stays, it takes effect once you accept it, enter into an Extended Stay Agreement with us referencing these Terms, or start using our Service for that purpose.
14.2 Termination Events
If you breach any part of this Agreement (including any Additional Terms or House Rules), or if Nova Vacation LLC loses the right to lease or manage a Property, all licenses and permissions granted to you end immediately. We may also terminate or suspend your account or reservation at our discretion, subject to any governing law.
